A woman who accused an Uber driver of sexual assault is suing both the driver and the ride-share company.
On Wednesday, lawyers for the unidentified woman filed a
lawsuit in the 73rd District Court against Uber Technologies Inc. and
Juan Ontiveros, 28.
Ontiveros was arrested on suspicion of sexual assault in
October 2017 by Bexar County sheriff's deputies. While being taken into
custody, Ontiveros defended himself to reporters by exclaiming "she was

The woman had called deputies after she woke up in Ontiveros' home Feb. 25, according to an arrest affidavit and the lawsuit.
The woman had spent the evening celebrating a friend's birthday, and hailed an Uber to take her home, she told authorities.
Ontiveros, the Uber driver, picked her up but never took
her home, officials said. He told deputies the woman fell asleep in his
Ontiveros told deputies he tried to wake her up. The woman briefly got out of the car but entered it again, he claimed.
He said he drove her around the block several times
before he decided to take her to his home roughly 30 miles away,
according to the arrest affidavit. He told deputies he wanted to drop
her off at a "safe place" so he could keep working. He also admitted
keeping her fare open so she would be charged more money, according to
Ontiveros consented to taking a Sexual Assault Nurse's
Exam, which indicated her DNA was found on him, according to the
Ontiveros is still out on bond in the criminal case and his trial is set for May 31.
The lawsuit holds Uber partially responsible, saying the company was "negligent, careless and reckless" when hiring Ontiveros.
The woman want's the civil lawsuit to be tried by a jury, according to the lawsuit.
