UPDATE 04:30AM

MONTANA - The Police News has learned that fugitive John Franklin Day had ditched the car the pair were traveling in and they were attempting to cross into Canada on foot.  Police say Day had attempted to remove the vehicle identification numbers (VIN) from his car so police could not connect it to he and Fichera and thereby discover they had gone into Canada.
Authorities in Montana say the pair were spotted by a farmer on road in a sparsley populated, rural area.  He reported to police the pair seemed suspicious and out of place in that area of the country.

When police detained them and check their ID's through the National Crime Information Center, they immediately took them into custody.

There is no information this morning on whether or not Fichera will be charged with anything or if she will be released.  Arrangements will be made by the Harris County Sheriff's Office to return Day to Harris County to face charges of Indecency With A Child and Failure to Appear in Court.  The original bond of $20 million was withdrawn Wednesday by State District Judge Jan Krocker who has denied bail meaning he will be held in jail until his trial.

UPDATE

MONTANA - Franci "Sissy" Fichera, 18, and her 41-year old sex offender, fugitive, husband have been arrested in Montana attempting to cross into Canada.  The Police News received that information a few minutes ago from the Texas Attorney General's Office and confirmed it with Fichera's mother.

Since there are no criminal charges against Fichera, she is likely to be freed in Montana unless immigration officials charge her with attempting to enter Canada illegally.

John Franklin Day, is wanted by Pasadena and Harris County authorities on charges of Indecency With A Child and Bond Jumping.  State District Judge Jan Krocker has ordered he be held without bond once he is returned to Harris County.

TEXAS CITY - Franci "Sissy" Fichera, 18, began a courtship with convicted 41-year old sex offender John Franklin Day, and later married him over the objections of her parents.  Her mother is a Texas City resident and father lives in Santa Fe, Texas.

Neither parent has seen or heard from Franci since August 4th.  A missing persons report has been filed with the Houston Police Department and a felony warrant has been issued for the arrest of Day for failure to appear in court to answer charges of Indecency with a Child, a case which originated in Pasadena, Texas.

Information from the Harris County District Clerk's Office indicates Judge Jan Krocker originally set bond at $20 million on Day upon his capture, but later changed it to NO bond.

Franci's Blackberry cellphone was discovered Saturday, along with another cellphone, wrapped in a plastic bag and discarded in a remote area where they were found by a lawn maintenance man.

Persons with any information as to the whereabouts of either Franci Fichera or John Franklin Day should call the nearest law enforcement agency or Houston Crime Stoppers at 713-222-TIPS (8477).

Mr. Porter, I can not thank you enough for posting Franci's missing poster. You are the only one to my knowledge who has attempted to publicize her missing and help her family. I realize she is now an 18yo adult and married to this man, BUT she just graduated and is very impressionable. He is much older w/ lots of experience in manipulating younger girls which is the case w/ Franci. She was an avid soccer player from very young and has natural beauty. I ask anyone and everyone to please take notice and notify the above phone number w/ any information. I ask this as a parent of young impressionable teens myself. My sis had some info on this creep.. not recently but called Crime Stoppers to give what info she had on him thinking it may help. Crime stoppers (CR Martinez contact at Crime Stoppers) said he couldn't find ANYTHING in their database.. had her on hold forever and acted quite disinterested stating that Franci is an adult and that nothing could be done. He didn't ask my sis anything name.. phone, etc.

Does anyone know what it takes to get this in the media???? FOX, ABC, CBS, CNN, etc..... We have sent it to ABC, NBC and CBS with no response. I am sure that there is a process that needs to be followed in order to make this happen. 20 Million dollar Bond upon his capture and a Child Sex Offender should get in the public view I would think.

Has anyone checked with The Brock Group. He was a long term employee (Manager) for them and they knew of his past record and hide it from there customers.Don't know if he still works there.

Thank goodness she's safe. Hopefully, in time she will understand how bad this situation was, and that "love" isn't found in a predator....they always use their target of "affection" for their own twisted needs. SO glad this wasn't a search and recovery situation....

God is sooo good! Thank you again Mr. Porter for your publicity on your website. There are so many words to say...So, just a few thoughts...just because someone is now "by law" an "18yo adult" and is "married" doesn't mean that they're mentally and emotionally an adult. I mean heck, there are much older adults who make very unwise decisions but we must not give up on the ones we love nor give up to help others in need. Emotions/feelings are extremely powerful and can cause some to do the most unspeakable things. I praise God Franci is separated from this individual and God will allow her thoughts to clear in time. Glad they were found. I can only imagine what her family is going through. Hopefully now that he will be locked up she can get her mind straight and cut ties with this sicko. Keeping you all in my prayers.

So thankful that Franci can come home safe to her parents. Some girls are not as fortunate in this type of situation. He prayed on young girls...this man is sick!! Now he can do 20 years in the BIG pin!!!

I'm very sorry for everyones misunderstanding of me "missing". Because I was never "missing", I was with my husband. Who is nothing that any of you have put him out to be. I hope all of you feel like fools.

I have been known John since 2006 and he is not as bad as everyone thinks. He is actually a good guy if you get to know him. I used to work with him and he is a pretty good manager. The only thing John loves good looking ladies and I dont see nothing wrong with that. John we are with you and you know who are your true friends.

In his spare time, John enjoys being a felon, staying registered as a sex offender, allegedly being indecent with children, skipping court dates, violating parole, unemployment, crossing state lines to avoid prosecution, illegally attempting to immigrate, etc. He will be spending 20+ years in prison (this time). With the pending charges, he will be the favorite of inmates and won't be the same when he leaves prison at 60+ year of age. Not someone to be buds with.
