On March 17, 2018, deputies with Constable Mark Herman’s Office responded to the 2400 block of West FM 1960 in reference to a child left in a locked vehicle. When deputies arrived, Emergency Medical Services was on location and advised that when they arrived, they observed the child inside the vehicle, with the windows cracked open slightly. EMS stated that the mother ran up to them and removed the child from the car. The child was limp, unconscious, and extremely sweaty. EMS provided medical care to the child.

Further investigation by deputies revealed that the defendants, Brenda Hurtado and Antonio Hurtado, had come to the location to eat. The 4-year-old child was asleep and Antonio Hurtado placed the child into the car to sleep and then went back inside the restaurant. Brenda advised that the child had been in the vehicle for approximately 30-40 Minutes.
