            A jury convicted George Esah Abane of Driving While Intoxicated on January 11, 2018 before he was sentenced to probation in an agreement with prosecutors.  The 22 year-old Houston man was arrested after causing a car accident in December 2016.

 

According to Assistant District Attorney Bryan Honeycutt, Abane caused a car accident on Highway 59 near Brazos Town Center around 7:30 am on December 26, 2016.  Rosenberg police quickly arrived to ensure the safety of the drivers and make sure the roads stayed safe.  No one was seriously injured in the crash.

 

Through her investigation, Rosenberg Police Officer Nicole Emidy determined that Abane caused the accident.  Under a suspicion that the defendant was intoxicated, Emidy evaluated Abane using the standardized field sobriety tests.  Abane later consented to a blood test, which revealed his blood alcohol level to be 0.146 – almost twice the legal limit in Texas.

 

In closing argument before the jury, lead prosecutor Bryan Honeycutt said, “DWI laws are essential because needless accidents like this happen – we were all brought here today because Mr. Abane made the decision to drive while he was intoxicated.  He endangered himself, his passenger, and everyone else on the road.”

 

            Abane was tried in County Court at Law No. 1 before Presiding Judge Christopher G. Morales.  Driving While Intoxicated in this case is a Class B Misdemeanor punishable by up to 180 days in jail and/or a fine up to $2,000.  The judge assessed Abane’s punishment at 15 months’ probation, including an $800 fine, 64 hours of community service, a DWI education class, and attendance at a victim impact panel where offenders hear from DWI victims who survived to tell their story.  Abane is also required to install an ignition interlock device on his vehicle.

           

            Assistant District Attorneys Bryan Honeycutt and Veronica Jones prosecuted the case.  Attorneys Jose Vela, Jr. and Daniel Cahill represented the defendant.
